By accessing our Website or placing an order, you agree to be bound by these Terms in full. If you do not agree with any part of these Terms, please do not use our Website or place an order.
Belgian Baked is a food business based in Montagu, Western Cape, South Africa. These Terms are governed by the laws of the Republic of South Africa, including the Consumer Protection Act (No. 68 of 2008) and the Electronic Communications and Transactions Act (No. 25 of 2002).
Use of the Website
You may use our Website for lawful purposes only. You agree not to:
- Use the Website in any way that violates applicable South African law or regulation
- Attempt to gain unauthorised access to any part of the Website, its servers, or any connected systems
- Use the Website to transmit harmful, offensive, or fraudulent content
- Reproduce, duplicate, copy, or resell any part of the Website without our express written permission

Placing an Order
By placing an order through our Website, you represent that:
- You are at least 18 years old, or have the consent of a parent or guardian
- The information you provide is accurate, complete, and current
- You have the authority to use the payment method provided
All orders placed through the Website constitute an offer to purchase. We reserve the right to accept or decline any order at our discretion. An order is only confirmed once we have sent you an order confirmation via email. Until that point, no binding agreement exists between us.
We make every effort to ensure that product descriptions, images, and prices on our Website are accurate. However, as our products are handmade, slight variations in appearance are natural and do not constitute a defect.
Pricing and Payment
All prices displayed on our Website are in South African Rand (ZAR) and are inclusive of VAT where applicable. We reserve the right to change prices at any time without prior notice, although any price changes will not affect orders that have already been confirmed.
Payment must be made in full at the time of placing your order through the payment methods available on our Website. We use secure third-party payment processors. Belgian Baked does not store your credit or debit card details.
Handmade Products
All Belgian Baked products are handmade in small batches using quality ingredients. Due to the handmade nature of our products, slight differences in shape, colour, size, and finish may occur between batches. These variations are inherent to artisanal production and do not constitute a defect or grounds for a refund.
Delivery
We currently deliver within the Western Cape only. Orders are typically delivered within 3 to 5 working days. Delivery fees will be communicated during the checkout process. While we make every effort to deliver within the estimated timeframe, delivery dates are not guaranteed and delays may occur due to circumstances beyond our control.
Risk in the products passes to you upon delivery. It is your responsibility to ensure that someone is available to receive the delivery at the specified address. If delivery cannot be completed due to incorrect address information or unavailability, additional delivery charges may apply.

Allergens and Dietary Information
Our products are produced in a facility that handles wheat, dairy, eggs, and other common allergens. While we take care to provide accurate ingredient information, it is your responsibility to verify that our products are suitable for your dietary requirements before placing an order. Belgian Baked accepts no liability for allergic reactions arising from the consumption of our products where ingredient information has been made available.
Refunds and Returns
Due to the perishable nature of our products, our refund and returns policy is strictly limited. Please refer to our Refund and Returns Policy for full details. In summary, refunds are not offered as a general rule. Exceptions may be considered on a case-by-case basis where products arrive damaged during delivery or where a clear error has been made on our part.
Intellectual Property
All content on this Website, including but not limited to text, images, graphics, logos, icons, photographs, and the overall design and layout, is the property of Belgian Baked or its content suppliers and is protected by South African and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on this Website without our prior written consent.
Limitation of Liability
To the fullest extent permitted by South African law, Belgian Baked shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Website or the purchase of our products. Our total liability to you for any claim arising from an order shall not exceed the total amount you paid for that order.
We do not guarantee that the Website will be available at all times, uninterrupted, or free from errors. We reserve the right to modify, suspend, or discontinue any aspect of the Website at any time without notice.
Indemnification
You agree to indemnify, defend, and hold harmless Belgian Baked, its owners, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Website, your breach of these Terms, or your violation of any law or the rights of any third party.

Belgian Baked shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, power outages, supply chain disruptions, pandemics, government restrictions, or industrial action.
Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these Terms or your use of the Website shall be subject to the exclusive jurisdiction of the courts of the Western Cape, South Africa.
